Ombudsman calls for clear rules for "Auszeit-WGs" facilities

Austria's Volksanwaltschaft is demanding the swift creation of a clear legal framework for future facilities known as "Auszeit-WGs." The call comes amid a discussion on how to deal with offenders under 14 who repeatedly commit serious crimes. ORF ↗

According to the ombudsman, the legal basis for the operation of these facilities needs to be precisely defined. Clear rules should regulate their status and create the conditions for setting up further such facilities. The Volksanwaltschaft is thereby responding to the ongoing public and political debate about ways to work with children under 14 who engage in repeated criminal activity.

The Austrian Ministry of Justice plans to submit a bill this autumn. It is meant to include the legal regulations needed for future facilities of this type. Specific details of the proposal have not yet been published. Der Standard ↗

The call for clear rules relates to the question of how the state should proceed with children who, due to their age, are not subject to ordinary criminal liability, but are nevertheless linked to repeated serious criminal activity. Further developments will depend on the Ministry of Justice's proposal and the subsequent legislative debate.
