Constitutional Court Sided with Jiřikovský, But He Remains in Custody

The Constitutional Court on Wednesday ruled that the Regional Court in Brno violated Tomáš Jiřikovský's rights when extending his detention in the bitcoin case. According to the ruling, the Brno court erred in its procedure toward the defense. Jiřikovský will not be released following the Constitutional Court's verdict, however. irozhlas.cz ↗

The core of the complaint concerned the decision on the detention of the main actor in the bitcoin case. The Constitutional Court established that the Regional Court in Brno did not allow the defense to respond to a statement that was essential for the decision on the further continuation of detention. In doing so, according to the court, it interfered with the procedural rights of the complainant. forum24.cz ↗

The ruling does not mean Jiřikovský's immediate release. The Constitutional Court sided with his objection to the justice system's procedure, but available information suggests that detention will continue for now. The case thus returns to the level of further procedural review, in which justice will have to take into account the criticisms raised by the constitutional judges. denik.cz ↗

The bitcoin case remains a closely watched case because Jiřikovský is identified as its main actor. Further developments will depend on how the general courts handle the Constitutional Court's ruling and whether they eliminate the alleged procedural errors when deciding on detention again. idnes.cz ↗
