British forces seize a Russian shadow fleet tanker in the English Channel for the first time. An invalid flag was the deciding factor

In the early hours of Sunday, British commandos fast-roped from Chinook helicopters onto the deck of the oil tanker Smyrtos in the middle of the English Channel and, after a six-hour operation, escorted it to the English coast. It was the first time the United Kingdom had independently detained a vessel from Russia's "shadow fleet" — a network of aging tankers that circumvents Western sanctions and generates money for the Kremlin's war against Ukraine. The decisive factor was a legal loophole rather than force: the ship had shortly before become a stateless vessel, which opened the way for it to be boarded and for British sanctions powers to be applied. A six-hour operation in the Channel

The action was led by Royal Marines from 42 Commando together with officers from the UK's National Crime Agency (NCA). The troops fast-roped from RAF helicopters directly onto the moving tanker — footage of the boarding was released by the Ministry of Defence. The operation was covered by the frigate HMS Sutherland, the minesweeper HMS Ledbury, Merlin Mk4 and Wildcat helicopters, and a P-8 reconnaissance aircraft, and was carried out in close cooperation with France. Why it was suddenly legal

The key part of the story is legal. Smyrtos sailed under the flag of Cameroon, but that flag was no longer valid: under diplomatic pressure from the European Union, Cameroon this month struck Smyrtos — and, according to the specialist outlet Navy Lookout, another 35 shadow fleet vessels — from its shipping register. This left the ship stateless, and under Article 110 of the UN Convention on the Law of the Sea (UNCLOS), a warship has the right to board a vessel where there is reasonable suspicion that it has no nationality at all. Once such suspicion is confirmed, London can then apply domestic legislation — most notably the 2019 Russia sanctions regime. What the "shadow fleet" is

The shadow fleet is a growing collection of old tankers with unclear ownership and insurance that transport oil for Russia beyond the reach of Western sanctions. Why the action came only now

Former armed forces minister Al Carns told the BBC that similar ships had previously been escorted through the Channel by a Russian frigate, and that "everything from the legal framework to the cargo" had to line up for the conditions for boarding to be met. "Now that the first boarding has succeeded, we will probably see more," he added. According to him, Britain had previously helped France and the US with similar actions, but had not led one itself. The action signals that Europe is tightening its approach to the shadow fleet at its western approaches as well, not only in the Baltic Sea, where the shadow fleet has also been linked to suspicions surrounding damage to undersea infrastructure.
