Constitutional Court Rules That Moon Dust Belongs to the Academy of Sciences

The Constitutional Court of the Czech Republic has finally ruled that samples of moon dust belong to the Academy of Sciences of the Czech Republic. It rejected the complaint filed by the daughter of a Czechoslovak researcher who received the samples in the 1970s as part of international scientific cooperation with the Soviet Union. idnes.cz ↗

The moon dust was brought to Earth by Soviet Luna program probes. The researcher obtained it for the purposes of scientific study, but the samples remained in her family's possession for decades. According to available information, the family kept them at home for nearly half a century, with part of the samples reportedly stored in a drawer. zpravy.aktualne.cz ↗

The ownership dispute eventually reached the Constitutional Court. It confirmed that the samples belong neither to the scientist's daughter nor to her family, but to the institution within which they were obtained and which they were meant to serve for scientific research. The ruling means the family must hand over the moon dust to the Academy of Sciences of the Czech Republic. novinky.cz ↗

The case concerned material that originated during a significant period of space research and international cooperation between Czechoslovakia and the Soviet Union. The Czech Constitutional Court's decision thus brought an end to a years-long dispute over ownership of unique scientific samples.

Following the court's ruling, the Academy of Sciences can now demand their handover and further decide on their scientific use. The researcher's family no longer holds ownership rights to the samples. seznamzpravy.cz ↗
